Difference Between Smuggling and Trafficking

Smuggling vs Trafficking

Smuggling can be defined as the transportation of goods or persons from one place to another in an illegal way. It is the carrying of goods or transportation of persons in violation of the existing laws and regulations.

Trafficking mainly refers to human trafficking. Apart from human trafficking, there is drug trafficking and arms trafficking. When referring to the type of crime, smuggling is a crime that is done against the state and not against a victim. In the case of human trafficking, there is a violation of the immigration laws. In the transportation of contraband items, there is a violation of the state laws. But trafficking is a crime against persons. Trafficking is the violation of the rights of an individual or violation of human rights.

When fighting against smuggling, the people fight for the protection of the sovereignty of a nation. In the fight against trafficking, it is a fight for protecting a person against human rights violations.

In smuggling, the relationship between the smuggler and the migrant ends after the illegal transportation and once the fee is paid. But in trafficking, the victim is frequently exploited even after the illegal act has been conducted. When considering human trafficking and human smuggling, the former is done without the consent of the victim. Even if the victim had given consent at the beginning, it becomes meaningless in the due course of time. Human smuggling is with the consent of the victim.

In human trafficking, there is an element of fraud, force, or coercion. But in human smuggling, there is no such force. The people who are being smuggled from one place to another generally cooperate even though they know they are violating the law.
